MIDDLETOWN -- Democratic nominee for New Jersey governor Phil Murphy brushed off outgoing Gov. Chris Christie's comments about whether Tuesday's election should be viewed as a referendum on his eight years in office and stuck to familiar territory as he cast his ballot.

Christie said on Tuesday if Lt. Gov. Kim Guadagno, the Republican nominee, wins, it's not an affirmation of his eight years, and if Murphy wins, it's not a rejection of his two terms leading New Jersey.

When a reporter asked him about Christie's comments, Murphy waved his hand and declined to take the bait. 

"You should ask Governor Christie that, I'm focused on what we're up to," Murphy said. 

'No. Good try,' Guadagno still won't talk about her boss on Election Day

Murphy kept the focus on the state's economy as he spoke to reporters outside Fairview School in Middletown, where he voted with his family.

"It's busted," he said. "We've been left behind. So we need to strengthen it (the economy), grow it again and make it fair."

Murphy said he feels comfortable with the final stretch of the election and that voter turnout will be key. 

"Listen, this is why they play the game," he said. "We have to close this thing out."

Flanked by his wife, Tammy, and their four children, who were wearing matching Allbird shoes, Murphy also said that this election is not a referendum on President Donald Trump. 

"It's a referendum on the economy," he said. "This is an economy which is not strong, not fair -- it doesn't work for enough people. That's what this is about." 

Both candidates voted Tuesday in Monmouth County.

Murphy, a former U.S. ambassador to Germany and Goldman Sachs banking executive, lives in Middletown. He and his wife own a $9.6 million mansion, on which they pay about $200,000 in annual property taxes, according to a recent report by the Asbury Park Press.  

When Murphy, 60, voted in the Democratic primary in June, it was the first time his name appeared on a ballot for elected office. 

Still, Murphy has led Guadagno by double digits in every major public opinion poll. But the gap has narrowed over the last few months. He was ahead by 27 percentage points in July but is now up by 14 in the most recent survey. 

On Tuesday morning, Murphy shrugged off any concern about the tightening polls.

"I only want to look at what we can control, which is our energy and the last couple hours we have left," he said. 

Guadagno, of Monmouth Beach, is a former Monmouth County sheriff, Monmouth Beach commissioner and federal prosecutor. But for the last eight years, she's served as Gov. Chris Christie's lieutenant governor. Guadagno, 58, was elected the first lieutenant governor in state history.

She and her husband own a $2.3 million home, on which they pay about $30,000 annually in property taxes, the Asbury Park Press reports. 

Regardless of who wins on Tuesday, one thing is certain: The next governor of New Jersey will be the first Monmouth County resident elected since Joseph D. Bedle in 1875. Bedle, a Democrat who was born in Matawan but built his law practice in Freehold, was the 23rd governor of New Jersey.

Man caught, held burglar until cops arrived, police say

The victim saw the suspect breaking into his car in North Trenton

TRENTON -- A resident caught a burglar in the act early Monday and physically held him down until police officers arrived to arrest him, police said. 

Officers responded to a call just after 7 a.m. of a man breaking into cars on Brunswick Avenue at Pine Street. 

When officers arrived, they found Christopher Nordgren, 48, of Hamilton underneath the owner of the car Nordgren was breaking into, police said. The man had seen Nordgren breaking in, and laid on top of him to keep him from running, police said.

Officers found Nordgren wrapped in a sleeping bag and wearing a coat that he swiped from inside the man's car, the owner told police. 

Nordgren was charged with burglary. He had previous warrants for his arrest in Hamilton.

How secure is N.J.'s election?

The New Jersey Office of Homeland Security says there are no known threats, but critics call for a dose of prevention.

TRENTON -- As voters head for the polls and elect New Jersey's next governor, state homeland security officials say there are no credible threats to the state's election system, which critics contend remains vulnerable to attack.

Russian attempts to undermine last fall's presidential election shone a bright light on the integrity of electoral systems across the country, but state authorities say they're confident in New Jersey's tight election security measures.

"On both fronts, from a technical standpoint and a physical site security standpoint, we are secure," Office of Homeland Security spokesman Patrick Rigby said Monday. "We want to make sure that there is no threat to the actual cyber security elements of the machines. It's equally important that the polling stations are completely secure.

But state Assemblyman Reed Gusciora, D-Mercer, said New Jersey's election infrastructure needs to be upgraded.

Gusciora, who filed a lawsuit in 2004 looking to force upgrades and has since sponsored legislation seeking to improve New Jersey's voting system, said it remains vulnerable to equipment glitches, programming errors and tampering.

Gusciora wants the states machines retrofitted to spit out a receipt after a voter casts their ballot, creating a paper trail to manually count and cross check results.

"We seem to accept out electronic results at face value," he said.

New Jersey is one of just a handful of states, along with Georgia, Delaware, Louisiana and South Carolina, with only paperless machines, according to The Huffington Post.

A recent report from The Center for Investigative Reporting found that it's not just tampering that needs to be guarded against. Dozens of voters for Cumberland County Democratic Committee were mis-recorded in 2011 because of an elections administrator's programming error, the report noted.

A law passed more than a decade ago requiring hard copies of vote tallies was later suspended for lack of funding. Sponsors of a similar measure introduced this spring have said that electronic machines that produce a paper record are now more widely commercially available.

"It's costly. It's in the millions of dollars. But you have to ask yourself, what's the cost of reliable democracy?" said Gusciora.

The Office of Homeland Security said in a statement it has beefed up security with tamper-evident seals on all voting machines, instituted training classes on voting machine security, required criminal and security background checks on everyone working on voting machines and installed anti-virus software on election management computers.

The incident left a person seriously injured.

BRICK -- Police are searching for a driver who struck and seriously injured a person in a road rage incident Tuesday behind a Brick grocery store.

The driver fled in an older model, black, Volvo four-door sedan that police say has smashed windshield and side-view mirror damage. The vehicle had a possible partial NJ plate of "F56."

The incident occurred shortly before 8:30 a.m. on Hooper Avenue near the back of a Stop & Shop, police said. The incident was described by police as sparked by road rage, but not additional information about the dispute was provided.

The suspect is described as a man in his 30s, dark hair and unshaven. He was wearing a red sweatshirt, jeans and sunglasses. 

The Ocean County Prosecutor's Office and the Brick Township Police Department are investigating. Anyone with information on the driver or vehicle may contact 732-262-1100.

Voter turnout 'brisk' in Jersey City; morning problems resolved

Problems were reported earlier today at the Mary McLeod Bethune Center where voters were delayed in casting their ballots for almost 2 hours when poll workers couldn't locate voter registration books for the polling place, according to Hudson County Board of Elections Clerk Michael Harper.

Voter turnout has been described as "brisk" today in Jersey City where voters are selecting a mayor, three at-large and six ward council people and three members of the Board of Education.

At S chool 11 on North Street a poll worker said voter turnout had been good.

Problems were reported earlier today at the Mary McLeod Bethune Center where voters were delayed in casting their ballots for almost 2 hours when poll workers couldn't locate voter registration books for the polling place, according to Hudson County Board of Elections Clerk Michael Harper.

Harper said there was a similar delay at the polling place at McNair Academic High School, but he said that delay was shorter, lasting only about an hour.

Two Superior Court judges on hand to sort out issues arising at polling places had heard only one matter between the hours of 6 a.m. and 1 p.m. today. The nature of that problem was not immediately available.

A half dozen Deputy Attorneys General were also on hand for such hearings at Hudson County Plaza on Cornelison Avenue in Jersey City.

Harper described today's voter turnout at brisk so far.

Workers from the Board of Elections have been traveling to polling places around the county to deal with issues such as people campaigning too close the polling station.

Another issue that has arisen is voters being told they cannot vote because their name is not in the voter registry. They should instead have been asked to fill out provisional ballots.

Election officials expect issues to arise more frequently after 4 p.m. when people begin to get off work and voter turnout picks up.

Harper said the problem at Bethune began Monday night after the office of the City Clerk delivered the voting books. He said a night security guard saw the books and didn't want to leave them out in the open. "So he locked them in a room."

Harper said when poll workers arrived in the morning, they couldn't locate the books. "Nobody knew where they were," Harper said. It took an hour and forty-five minutes to locate the books and get the polling place open and running, Harper said.

He said voters who were prevented from casting their ballots by the delays can ask the  judge to keep the polls open later than their 8 p.m. scheduled close. "I can't do anything unless a judge orders it," Harper said.

He described the problem at Bethune and McNair as not being unusual for an Election Day. "You want to hang them when you hear about it," he said, "but the issues were very normal."

A Hudson County detective is being hailed a hero for saving a pregnant woman from her car moments before the vehicle engulfed in flames.

A Hudson County detective is being hailed a hero for saving a pregnant woman from her car moments before the vehicle became engulfed in flames.

Jennifer Larson was driving south on the Garden State Parkway on Oct. 22 when she suddenly lost the ability to accelerate near the Driscoll Bridge. She heard a loud boom and her car began shaking.

Larson, who is six months pregnant, began maneuvering her car toward the shoulder of the roadway when she spotted a police car with activated lights and sirens in her review mirror. Det. Guershon Cherilien, who works in the Hudson County Prosecutor's Homicide Unit, moved quickly to help Larson.

Cherilien could see fire coming from underneath the car, but Larson was unaware of the seriousness of the situation. The detective helped Larson out of the car and kept her calm while State Police and the local fire department arrived at the scene to extinguish the flames.

The lock switches on Larson's vehicle malfunctioned after she was safely removed from the car and she credits Cherilien with acting with kindness in a "moment of life and death."

"If it had not been for Det. Cherilien quickly pulling behind me when he saw the flames burst from underneath my vehicle, I would have pulled over and sat in that car calling my insurance company until it would have been too late to escape," Larson said in a statement. "I can honestly say that he saved my life and the life of my daughter."

Hudson County Prosecutor Esther Suarez said she is grateful for Cherilien's actions on that Sunday.

"Det. Cherilien made several quick decisions during this incident and calmly moved the driver to safety," Suarez said in a statement. "His actions may have helped to save this woman's life and I am grateful that she was unharmed and I'm extremely proud of the bravery exhibited by Guershon." 

New Jersey Republican lawmaker Frank LoBiondo retiring

A senior member of the New Jersey congressional delegation is calling it quits.

WASHINGTON -- Rep. Frank LoBiondo, the New Jersey Republican who most often breaks with his party, announced his retirement Tuesday with a blast at the partisanship that has taken over U.S. politics.

"I always looked for solutions that produce real world results built upon cooperation and partnerships," said LoBiondo, R-2nd Dist. "Regrettably, our nation is now consumed by increasing political polarization; there is no longer middle ground to honestly debate issues and put forward solutions."

His retirement puts the congressional district up for grabs in the 2018 election.

LoBiondo, who first elected in 1994 as Republicans ended 40 years of Democratic control of the House and has served 11 terms on Capitol Hill, said the timing was right for him to leave because term limits required him to give up his aviation subcommittee chairmanship and his seat on the House Intelligence Committee.

N.J. races key to 2018

"Furthermore, as some of my closest colleagues have also come to realize, those of us who came to Congress to change Washington for the better through good governance are now the outliers," LoBiondo said. "A vocal and obstinate minority within both parties has hijacked good legislation in pursuit of no legislation."

LoBiondo's most recent act of defiance against his party came last month when he voted against the congressional budget resolution targeting the deduction for state and local taxes. He also was one of three House Republicans from New Jersey to oppose health care legislation that the Congressional Budget Office said would leave 23 million more Americans without insurance.

Last year, LoBiondo, 71, crossed party lines and voted with a majority of Democrats against a majority of Republicans 16.9 percent of the time, putting him ninth among all House GOP lawmakers, according to Congressional Quarterly.

This year, he was one of only nine House Republicans to oppose repealing regulations on coal companies in order to protect streams and drinking water supplies.

He also fought President Donald Trump's proposals that could lead to offshore drilling in the Atlantic Ocean and was one of 24 House Republicans who introduced a resolution in March calling for actions to combat climate change, which the president has called a Chinese hoax.

"With LoBiondo retiring, New Jersey is losing one of the last of our moderate-on-the-environment Republicans," said Jeff Tittel, director of the New Jersey Sierra Club. "Pro-environment and climate-change-protection Republicans have become an endangered species."

LoBiondo also was a strong supporter of organized labor. He received $335,000 in contributions from unions in 2016, more than any other House member running for re-election, according to the Center for Responsive Politics, a Washington-based research group.

He was one of only three House Republicans who earlier this year opposed repealing a regulation by the Occupational Safety and Health Administration making it easier to track workplace injuries.

While the Democratic Congressional Campaign Committee named LoBiondo as one of the four New Jersey House Republicans it was targeting, he did not receive the attention as the other three, Reps. Tom MacArthur, R-3rd Dist., Leonard Lance, R-7th Dist., and Rodney Frelinghuysen, R-11th Dist.

A retired teacher, Tanzie Youngblood of Woolwich, is seeking the Democratic nomination.

The two Washington-based publications that track congressional races, the Cook Political Report and Inside Elections, both rated LoBiondo as a safe bet for re-election.

His retirement, however, "opens up a very competitive seat that President Obama easily won twice," DCCC spokesman Evan Lukaske said.

Off-duty cop 'acted heroically' in shooting of accused robber, union leader says

Robbers tried to hold-up off-duty police officer early Tuesday, according to authorities.

NEWARK -- A 19-year-old man faces robbery and weapons charges after he was shot by an off-duty Newark police officer in an exchange of gunfire in the city early Tuesday, officials said.

Justin McGriff and at least one other suspect tried to rob the off-duty officer around 12:30 a.m. in the 100 block of Wainwright Street, according to authorities.

"When he identified himself as a police officer, one of the suspects fired a weapon," acting Essex County Prosecutor Robert D. Laurino said in a statement. "The off-duty Newark police officer returned fire, shooting one of the suspects."

Police arrested McGriff, who was wounded, a short distance from the robbery scene on Leslie Street, according to the prosecutor. He was taken to University Hospital, where his condition was not immediately available.

Prosecutors also charged McGriff with conspiracy. He has not been accused of shooting at the officer.

At least one other suspect fled the scene, authorities said. The Newark officer was not wounded in the attack.

James Stewart Jr., president of the Newark Fraternal Order of Police, said the officer was a 27-year veteran of the city's force.

"He acted heroically in a life and death situation and I tip my cap to him on a job well done," Stewart added. "We are looking forward to the apprehension of the two suspects on the run, we know who we're looking for, their time as free men is quickly dwindling."

McGriff, of Orange, was previously charged with a March 15 armed robbery in Newark's West Ward, where he allegedly stole a man's cell phone, cash and other items at gunpoint, according to authorities and records.

He was held at the Essex County jail for four days after that arrest, according to county corrections department records. The status of that case was not immediately clear.

The shooting marked the second incident in the past two weeks where officials said an off-duty law enforcement officer shot at men who tried to rob him in Newark.

On Oct. 29, an off-duty Jersey City police officer fatally shot two men who allegedly tried to rob the cop at gunpoint in the city's Central Ward. Investigators said one of the men tried to shoot the officer, but the gun jammed.

Ex-Phillies ace Roy Halladay dies in plane crash

Halladay pitched for the Blue Jays and Phillies during a 16-year career. He was 40 years old.

Former Phillies star pitcher Roy Halladay died in a plane crash in the Gulf of Mexico off the coast of Tampa, Fla. on Tuesday. He was 40.

CBS Philly first reported on the plane crash. Tampa Bay's CBS affiliate reported that the plane was owned by Halladay.

The Pasco County (Fla.) Sheriff's office held a press conference at 4:15 p.m., at which time Sheriff Chris Nocco confirmed Halladay's death. Nocco said they are currently engaged in a recovery effort and that Halladay's body has been located.

The plane which crashed was a two-person plane, but Nocco said Halladay was the only person on board at the time of the crash. Nocco said they will be recovering plane debris for the next few hours.

Nocco said the National Transportation Safety Board will be leading the investigation. He confirmed that the tail number on the plane which crashed matched the tail number on the plane owned by Halladay. The sheriff's office cannot confirm if Halladay had filed a flight plan.

The Phillies released a statement shortly after Halladay's death was announced:

Halladay, a star with the Phillies from 2010-2013, recently tweeted photos of himself flying.

Halladay pitched in the majors for 16 seasons, making eight All-Star teams during his time with the Toronto Blue Jays and Phillies. The righty was a two-time (2003, 2010) Cy Young winner.

In four seasons with the Phillies, Halladay pitched to a 3.25 ERA and finished top-2 in the Cy Young voting twice.

On May 29, 2010, Halladay pitched the 20th perfect game in baseball history, beating the then-Florida Marlins 1-0.

Bayonne voters go to polls with governor's race on their minds

Most voters interviewed this morning were excited about the governor's race, but not so much for the local races, where Democrats were again expected to win easily.

Election Day is a day when U.S. citizens can voice their opinion for change.

Across Bayonne, people made their way to polling places like Bayonne High School and Horace Mann Community school to cast their votes for school board candidates, state legislators, a freeholder -- and a new governor.

The front-runners for governor are Democrat Phil Murphy and Republican Kim Guadagno.

"I'm here because I want to see a different governor. I came out for Murphy because I don't want another Christie," said Wayne Baptiste, referring to Guadagno's eight years as lieutenant governor under one of the most unpopular in state history.

Most voters interviewed this morning were excited about the governor's race, but not so much for the local races, where Democrats were again expected to win easily. Locally, voters were to decide on three school board members, an unopposed freeholder and two assembly members and a state senator.

Marie Scrudato, a poll worker at Bayonne High School said both Guadagno and Murphy "have strengths and weaknesses, so I think it's pretty much a level playing field."

She was more bothered by the low voter turnout at the high school.

"I'm a little disappointed that the voter turnout hasn't been that great," Scrudato said. "That's upsetting to see" that some people take voting for granted. She noted that some immigrant families came to the school and couldn't wait to cast their ballots for the first time.

"It was great to see how excited they were," Scrudato said. "It's just disappointing though when you have American citizens who don't even bother to vote. To some of them, they felt it just doesn't count and that it's not going to affect them. That's what's sad about it." 

Voters also went to the polls for public questions on ensuring reparation for natural resource destruction or contamination be used only to repair and restore the state's natural resources; and funding the construction and renovation of libraries.

"I feel strongly that the money for the environmental cleanup should be used where it's supposed to be used," Scrudato said. "I'm upset that Christie took the (the $225 million Exxon settlement for environmental damages at refineries in Bayonne and Linden) away from Bayonne because ... we had land that needed to be cleaned up. Linden had the same problem, too, and it didn't go to any of us. Maybe a little bit of it did, but the money was used for other issues." 

During the campaign, Murphy has repeatedly said that a vote for Guadagno is a vote for four more years of Christie.

"This isn't going to be a tight election," said voter Mike Vitale. "Murphy shouldn't have any trouble beating her. If you go with Guadagno, you're just going to get Christie again. He taught her everything she needs to know." 

While there wasn't much support for Guadagno, everyone seemed to agree that it's time that New Jersey gets a fresh start.

"I served in the Army for three years so I think that's enough of a reason to come out to vote," said Maurice Kahan, a Bayonne resident, formerly from Baltimore. I'm not a fan of Christie, so I think it's time for a change."

Jury in Menendez trial asks for the 'definition of a senator'

Defense attorneys have argued Menendez did not take any "official acts" on his co-defendant's behalf.

NEWARK -- On the first full day of deliberations in U.S. Sen. Robert Menendez's federal corruption trial, the jury had one question: what is the defense definition of a "senator"?

Attorneys for the Democratic lawmaker and Salomon Melgen, the wealthy Florida ophthalmologist accused of bribing Menendez, returned to the courtroom after jurors passed a note to the judge indicating they had a question.

One of the jurors, U.S. District Judge William H. Walls told attorneys, wanted a read-back of defense attorney Abbe Lowell's closing remarks "apropos the definition of a senator."

While it was unclear what the juror meant by "definition of a senator," Lowell -- the lead attorney on the senator's defense team -- had argued in closings that there were certain official acts Menendez could have taken on Melgen's behalf in his role as a U.S. senator --  such as crafting legislation or holding hearings -- but did not.

The Justice Department has accused Menendez, 63, of intervening on Melgen's behalf at the highest levels of Health and Human Services and the State Department in exchange for lavish bribes.

Attorneys for the lawmaker have argued the senator's meetings with government officials in the case -- including former U.S. ambassador Bill Brownfield and former HHS Secretary Kathleen Sebelius -- were part of routine legislative activity involving policy matters of concern to Menendez.

After conferring with both parties, Walls called the jury back to the courtroom and instructed the panel of seven women and five men that they were to rely solely on their "individual and collective memories of what was said by Mr. Lowell."

Walls, who directed jurors to a section of the jury charge instructing them to consider as evidence only testimony elicited from witnesses or exhibits introduced as such, did not read back Lowell's closing remarks.

Walls excused the jury for the day at 4 p.m. at the jurors' request. Deliberations are expected to resume Wednesday at 9:30 a.m.

5 people shot during violent weekend in Jersey City

JERSEY CITY - Five men were shot in less than 36 hours during a violent weekend in Jersey City, officials said.

No arrests have been made in any of the shootings between Friday evening and early Sunday morning, city spokeswoman Jennifer Morrill said.

A 25-year-old man and 17-year-old boy, both of Harmon Street, were shot at about 7:30 p.m. Friday at the Marion Gardens housing complex. One of the victims was transported by a private auto and the second was brought by first responders to Jersey City Medical Center, Morrill said.

Both suffered injuries that were not considered life-threatening and would not provide details of the shooting to authorities, she said.

Then just before midnight, a 22-year-old Halladay Street man was shot in the cheek and abdomen near the Salem Lafayette housing complex on Union Street, Morrill said. An update on his condition was not immediately available.

Early Sunday morning a 42-year-old was shot in the calf on Van Nostrand Avenue. Morrill said that victim was also uncooperative with police and was treated at Jersey City Medical Center at about 1:30 a.m.

A fifth man was shot a few hours later, again at Marion Gardens, at about 4:30 a.m. The 24-year-old Carteret man suffered a nonlife-threatening gunshot wound to his buttocks and was brought to Christ Hospital by a friend, she said.

The shootings all remain under investigation.

Search underway for missing 84-year-old woman who has Alzheimer's

The woman was last seen at a Trenton hospital at about 1:20 p.m. Tuesday

TRENTON -- Police in Mercer County are searching for a Ewing woman who walked away from Capital Health Regional Medical Center in Trenton Tuesday afternoon.

Betty Morocco, 84, has Alzheimer's disease.

Morocco walked out of the hospital in North Trenton at about 1:20 p.m., Trenton police said.

Morocco was visiting someone and arrived with a relative. She was not a patient, police spokesman Lt. David Cruz said.

Trenton police were alerted at 2:20 p.m.

Morocco is white, stands 5-feet 4-inches tall and weighs about 180 pounds. She was wearing black clothing and carrying a beige purse.

Police made public security camera footage of her in hopes the public can help locate her.

Police seek N.J. man missing from his New York apartment

Sean Pohle has been missing since Nov. 3, 2017, when he told his girlfriend he was going to work.

NEW YORK -- A Hunterdon Central Regional High School graduate has been missing since Friday, when he left his apartment in New York City.

Police are searching for Sean Pohle, 24, who was reported missing after his girlfriend realized it was late for him to be coming home from work. Their last contact was at 4:27 p.m. on Friday.

Pohle drives a black Honda Civic with New Jersey license plates, with his last known location crossing the George Washington Bridge into New Jersey.

The former Flemington resident is described as a white male, 5-feet, 11-inches tall, weighs 150 pounds, and usually wears skinny jeans, a v-neck shirt and black Nike sneakers. He has brown hair, hazel eyes and wears black, square glasses.

Alexa Haynes, his girlfriend, believes he could be wearing a green crew neck shirt.

Raritan Township police said Pohle's family, who still live in Flemington, is concerned and involved in searching efforts. Because he was reported missing in New York City, police there are leading the investigation.

Haynes said Pohle didn't show up to work and called out sick, but told her he was going to work. She said he wasn't in "the right state of mind" and just wants to find him.

"I'm worried about his well being and just want to find him and get him home and safe. The why's and how's can wait until then. I just need to know he is okay," she said.

Pohle's family and Haynes have been searching places he may be, including past schools, his hometown and last known locations, she said. Sean's older brother, Michael Pohle, Jr., was among the victims of the Virginia Tech shooting in 2007. 

"We've been putting in every effort to find him," she said. "I really miss him and just want him to come home."
